Drivers from out of state will not be penalized by the civil system of fees because “the state can not go beyond its borders to collect the (civil) fees,” said Moore. “These fees are for Virginia residents and those with a permit listing a Virginia address.”

Regular traffic fines for tickets must be paid by all, so these fines should apply to everyone or no one. How is fining someone breaking a traffic law in the state over stepping their bounds just because of where the person lives?
As usual, our elected elite took the initial makings of a good idea and ran full speed with it in the wrong direction. Assholes.

Date: 2007-06-21 01:47 pm (UTC)If they were legal fines/fees, then someone could make an argument about "cruel and unusual punishment" (comparing the fees against other states, the fact that they are charged over a period of years, etc).
But, since they are civil fines, it may be harder to make that case.
How is fining someone breaking a traffic law in the state over stepping their bounds just because of where the person lives?
Because the portion accrued in year 2 and 3 is being handled by a collection agency. In order to collect, the agency (for this purpose "An Agent of the State") would have to cross state lines to collect the fines.
The state can't tell the agency to do that.
